OHSU to pay $1 million, promises change to settle lawsuit from widow of cancer patient

The Oregonian May 04, 2022
OHSU will pay a $1 million settlement in response to a lawsuit regarding the death of a patient with cancer. OHSU statement: "OHSU extends its sincere condolences to the family and friends of Mr. McIntyre. As a community of healers devoted to advancing health, the passing of a patient, under any circumstances, is devastating to all involved. Patient privacy laws prevent us from disclosing protected health information; however, we want to share the following: • OHSU has followed, and continues to follow, national cancer guidelines and evidence-based medicine set forth by national expert consensus in the field. • National treatment guidelines established by the major cancer societies in the U.S. do not recommend DPD, or dihydropyrimidine dehydrogenase, testing prior to starting chemotherapy. • Although DPD testing is not part of the standard of care for delivering chemotherapy, OHSU is enhancing its educational component on DPD deficiency in its Oncology Fellowship program. • OHSU also plans to create a Resource Guide that describes DPD deficiency, how it relates to metabolism of capecitabine and what to look for in relationship to early-onset symptoms -- this Resource Guide will be available to everyone in the oncology department."
